The Deputy Prosecutor of the International Criminal Court, Mame Mandiaye Niang, concludes his visit to the Democratic Republic of the Congo on the occasion of the roundtable on the status of the handling of priority cases by Congolese judicial authorities
On 16 November 2023, the Deputy Prosecutor of the International Criminal Court, Mame Mandiaye Niang, concluded an official visit to the Democratic Republic of the Congo (DRC) during which he participated in the roundtable on the status of the handling of priority cases by Congolese judicial authorities.
This visit followed the earlier mission by Prosecutor Karim A.A. Khan KC to the DRC, in June 2023, on the occasion of which he signed a memorandum of understanding to reflect a new approach of complementarity and cooperation in the fight against impunity. This agreement foresaw a series of measures to help accelerate the implementation of the DRC national strategy for the prosecution of international crimes through the priority cases.
The roundtable, which gathered the provincial military prosecutors responsible for the priority cases, United Nations representatives, and other technical partners, is an important milestone in the implementation of this new approach promoted by Prosecutor Khan. It was an opportunity to take stock of the implementation of the national strategy for the prosecution of international crimes and to discuss approaches in order to increase the impact of the fight against serious crimes committed in the DRC.
At the outset of the roundtable, the Deputy Prosecutor stated: “Today’s activity, marking the launch of our exchanges on the priority cases, is an eloquent manifestation of the meeting of common wills between the ICC Office of the Prosecutor and the DRC”.
The meeting addressed the efforts made in various DRC provinces in the handling of the priority cases despite the challenges. Encouraging this work, which has led to the opening of a significant number of cases and convictions, the Deputy Prosecutor recalled: “The Office of the Prosecutor will continue to support the conduct of genuine national investigations and prosecutions. We will continue to do our best to strengthen the capacity of the national judicial systems. And where those jurisdictions lack the means to act or need support to conduct genuine proceedings, our Office will be there. This is the vision of complementarity promoted by Prosecutor Khan”.
He further emphasized the importance of accompanying partners in support of national prosecutorial efforts and invited the technical partners to pursue this necessary collaboration: “Given the complexity of the situation, cooperation and good coordination are essential to increase the impact of criminal justice in the face of crime and its disastrous consequences on the victims, the communities and the Congolese population. The implementation of a national consultation forum on the priority cases, as recommended by the participants, makes sense. I invite all the participants, national authorities as well as technical partners, to take ownership of this forum in order to deepen the exchanges and develop the necessary synergies to reinforce the efforts in the handling of priority cases and strengthening the technical capacity of national judicial actors, including in the field of forensics”.
During his meeting with civil society organisations, Deputy Prosecutor Niang recalled that “CSOs play an important role in support of the Office’s activities; they are privileged partners who we rely on to enhance the dialogue in the implementation of our mandate”.

Deputy Prosecutor Niang met with H.E. Mrs Rose Mutombo Kiese, Minister of Justice and Keeper of the Seals, Professor Taylor Lubanga, National Focal Point of the ICC and Chargé de mission to the Head of State, Mr Firmin Mvonde, Prosecutor General at the Cour de Cassation, and Mr Likulia Bakumi Lucien, General Prosecutor at the High Military Court. He highlighted the positive cooperation of the DRC with the Office of the Prosecutor and commended the important efforts undertaken by national authorities in the fight against impunity in order to bring justice to the victims and the affected communities.
Deputy Prosecutor Niang also met with representatives of the diplomatic corps and missions, with whom he discussed the activities of the Office in the DRC and explored avenues for coordinating the initiatives of technical and financial partners in support of the work of national authorities in the fight against impunity for international crimes and transitional justice. The Office expresses its gratitude to all the Ambassadors present on this occasion, and reiterates its thanks to H.E. Angèle Samura, Ambassador of the Kingdom of the Netherlands, and H.E. Ingo Herbert, Ambassador of the Federal Republic of Germany for facilitating the meeting.
The Office of the Prosecutor expresses its gratitude to the Congolese authorities for the warm welcome extended to the delegation led by Deputy Prosecutor Niang.
The Office also expresses its gratitude to the Organisation Internationale de la Francophonie for its general financial contribution, which made the organisation of the roundtable possible.

Le Procureur adjoint de la Cour pénale internationale, Mame Mandiaye Niang, conclut sa visite en République Démocratique du Congo à l’occasion de la table ronde sur l’état des lieux du traitement des cas prioritaires par la justice congolaise
Le 16 novembre 2023, le Procureur adjoint de la Cour pénale internationale, Mame Mandiaye Niang, a conclu une visite officielle en République Démocratique du Congo (RDC) au cours de laquelle il a participé à la table ronde sur l’état des lieux du traitement des cas prioritaires par les autorités judiciaires nationales.
Cette visite s’inscrit dans le prolongement de celle du Procureur Karim A.A. Khan KC en RDC, en juin 2023, à l’occasion de laquelle il a signé un mémorandum d’entente devant traduire une nouvelle approche de complémentarité et de coopération dans la lutte contre l’impunité. Cet accord prévoyait une série de mesures devant contribuer à l’accélération de la mise en œuvre de la stratégie nationale de poursuites des crimes internationaux dans le cadre des cas prioritaires.
La tenue de la table ronde qui a réuni des Auditeurs militaires provinciaux en charge des cas prioritaires, des représentants des Nations Unies, et autres partenaires techniques, est une étape importante dans la mise en œuvre de cette nouvelle approche impulsée par le Procureur Khan. Elle a été l’occasion de dresser l’état des lieux de la mise en œuvre de la stratégie nationale de poursuites des crimes internationaux et d’échanger sur les approches en vue d’amplifier l’impact de la lutte contre les crimes graves commis en RDC.
A l’ouverture des travaux, le Procureur adjoint a déclaré : «l’activité d’aujourd’hui marquant le lancement de nos échanges sur les cas prioritaires est une manifestation éloquente de la rencontre de volonté commune du Bureau du Procureur et de la RDC ».
Les discussions ont permis de mesurer les efforts déployés dans les différentes provinces de la RDC dans le traitement des cas prioritaires en dépit des défis. Encourageant ce travail ayant conduit à l’ouverture d’un nombre important de dossiers et à des condamnations, le Procureur adjoint a rappelé: « Le Bureau du Procureur va continuer à soutenir la conduite d’enquêtes et de poursuites nationales véritables. Nous allons continuer à contribuer de notre mieux au renforcement des capacités des systèmes judiciaires nationaux. Et là où ces juridictions n’ont pas les moyens d’agir ou ont besoin de soutien en vue de conduire des procédures véritables, notre Bureau sera au rendez-vous. Telle est la vision de complémentarité impulsée par le Procureur Karim Khan ».
Il a en outre souligné l’importance de l’accompagnement des partenaires en appui aux efforts nationaux de poursuite et a invité les partenaires techniques à poursuivre cette collaboration nécessaire : « Face à la complexité des problématiques, la coopération et la bonne coordination sont essentielles pour accroître l’impact de la justice pénale face à la criminalité et à ses conséquences désastreuses sur les victimes, les communautés et la population congolaises. La mise en place d’une plate-forme de concertation nationale sur les cas prioritaires, telle que recommandée par les participants, revêt ici tout son sens. J’invite les autorités nationales, tous les participants et partenaires techniques, à s’approprier cette plate-forme pour approfondir les échanges et développer des synergies nécessaires pour renforcer les efforts dans le traitement des cas prioritaires et de renforcement des capacités techniques des acteurs judiciaires nationaux, y compris en matière de médecine légale. »
Lors de sa rencontre avec les organisations de la société civile, le Procureur adjoint a rappelé rôle important de soutien aux activités du Bureau des ONGs : « elles sont des partenaires privilégiés avec qui nous comptons accentuer le dialogue dans la mise en œuvre de notre mandat. »

Le Procureur adjoint s’est entretenu avec S.E. Mme Rose Mutombo Kiese, Ministre de la Justice et Garde des Sceaux, M. le Professeur Taylor Lubanga, Point Focal National de la CPI et Chargé de mission du Chef de l’État, M. Firmin Mvonde, Procureur général près la Cour de Cassation, et M. Likulia Bakumi Lucien, Auditeur Général près la Haute Cour Militaire. Il a magnifié la coopération positive de la RDC avec le Bureau du Procureur et saluer les importants efforts entrepris par les autorités nationales dans la lutte contre l’impunité afin de rendre justice aux victimes et communautés affectées.
Le Procureur adjoint Niang a profité de l’occasion de sa visite pour rencontrer les représentants du corps et missions diplomatiques avec qui il a échangé sur les activités du Bureau en RDC et exploré des pistes en vue de la coordination des initiatives des partenaires techniques et financiers de la RDC en appui au travail des autorités nationales dans la lutte contre l’impunité des crimes internationaux et la justice transitionnelle. Le Bureau exprime sa gratitude à tous les Ambassadeurs présents à l’occasion et renouvelle ses remerciements à S.E. Angèle Samura, Ambassadeur du Royaume des Pays-Bas et S.E. Ingo Herbert, Ambassadeur de la République fédérale d’Allemagne d’avoir facilité la tenue de cette réunion.
Le Bureau du Procureur de la Cour pénale internationale exprime sa gratitude aux autorités congolaises pour l’accueil chaleureux qui a été réservé à la délégation conduite par le Procureur adjoint Niang.
Le Bureau exprime également sa gratitude à l’Organisation Internationale de la Francophonie pour sa généreuse contribution financière qui a permis la tenue de la table ronde.
