ICC judges authorise Prosecution to resume investigation in Afghanistan
On 31 October 2022, Pre-Trial Chamber II of the International Criminal Court (ICC) authorised the Prosecution to resume investigation into the Afghanistan Situation. The judges considered that Afghanistan is not presently carrying out genuine investigations in a manner that would justify a deferral of the Court’s investigations and that Afghanistan authorities are not showing an interest to pursue the deferral request it submitted on 26 March 2020.
According to article 18(2) of the Rome Statute “[…] a State may inform the Court that it is investigating or has investigated its nationals or others within its jurisdiction with respect to criminal acts […]. At the request of that State, the Prosecutor shall defer to the State’s investigation of those persons unless the Pre-Trial Chamber, on the application of the Prosecutor, decides to authorize the investigation.”
In its decision issued today, Pre-Trial Chamber II considered that the material transmitted by Afghanistan does not show that Afghanistan has investigated, or was investigating, in a manner that covers the full scope of the Prosecutor’s intended investigations and that would justify even a partial deferral of the Court’s investigations. It also considered that Afghanistan authorities did not act in a manner that shows an interest in pursuing the Deferral Request of 26 March 2020.

Les juges de la CPI autorisent le Procureur à reprendre son enquête en Afghanistan
Le 31 octobre 2022, la Chambre préliminaire II de la Cour pénale internationale (CPI) a autorisé le Procureur à reprendre l’enquête sur la situation en Afghanistan. Les juges ont estimé que l’Afghanistan ne mène pas actuellement de véritables enquêtes d’une manière qui justifierait de déférer les enquêtes de la Cour et que les autorités de l’Afghanistan ne montre pas un intérêt à poursuivre la demande à ses fins présentée le 26 mars 2020.
Selon l’article 18-2 du Statut de Rome « […] un État peut informer la Cour qu’il ouvre ou a ouvert une enquête sur ses ressortissants ou d’autres personnes sous sa juridiction pour des actes criminels […]. Si l’État le lui demande, le Procureur lui défère le soin de l’enquête sur ces personnes, à moins que la Chambre préliminaire ne l’autorise, sur sa demande, à faire enquête lui-même.»
Dans sa décision rendue aujourd’hui, la Chambre préliminaire II a estimé que les éléments transmis par l’Afghanistan ne montrent pas que l’Afghanistan a enquêté, ou enquête, d’une manière qui couvre toute la portée des enquêtes envisagées par le Procureur et qui justifierait même un report partiel des enquêtes de la Cour. La Chambre a également considéré que les autorités de l’Afghanistan n’avaient pas agi d’une manière qui montre un intérêt à poursuivre la demande du 26 mars 2020 aux fins de déférer l’enquête.
