Reacting to the agreement reached by the Council on a General Approach on Omnibus I, BusinessEurope Director General Markus J. Beyrer, said: “Progress has been made on simplification, but key issues in Omnibus I remain unresolved.”
“On the Corporate Sustainability Due Diligence Directive (CS3D), more harmonisation across the EU is needed on operational due diligence requirements to avoid fragmentation and ensure legal certainty for companies. The reintroduction of the turnover-based sanctions is very disappointing. Their deterrence effect and suitability are highly questionable, especially given the legal complexity of due diligence issues.
Regarding the Corporate Sustainability Reporting Directive (CSRD), we welcome the additional threshold of €450 million in net turnover, which aligns better with the Taxonomy. However, consistency is still lacking when it comes to EU subsidiaries of non-EU companies. This should coincide with an exemption for purely financial holding companies without operational control.
We urge EU institutions to address these concerns in the upcoming negotiations to ensure legal clarity and workable implementation for companies.”
