(AGENPARL) – BRUXELLES ven 12 maggio 2023 The European Commission work programmes for 2021 and 2022 envisaged proposals to revise the core building blocks of the EU’s maritime safety legislation, such as the Directives on Port State and Flag State Control, the Directive on Accident Investigations, and the Regulation founding the European Maritime Safety Agency (EMSA). This implementation appraisal starts with a recap of the existing EU policy and legislation on flag States and accident investigations, then reviews and summarises existing evaluations and discussions on their implementation produced by EU institutions and their advisory bodies. The findings of the ex-post evaluations of the directives and statements by relevant stakeholders all indicate that the Flag State Directive and the Accident Investigation Directive have been well transposed and implemented by the Member States concerned and that the system generally performs well, thus contributing to the creation of a level playing field for the sector and increased capacities within national administrations. The directives, adopted in 2009 and in force since 2011, did not introduce major changes to the existing international rules or Member States’ practices, but integration into the EU acquis allowed harmonised enforcement. Today, based on the experience gained over more than a decade of relatively unproblematic implementation, the co-legislators should be able to review both directives to introduce further simplification and mostly technical updates, reflecting past and upcoming transformation of the industry (digitalisation, new fuels, autonomous vessels…), and to stay aligned with the International Maritime Organization (IMO) framework. A possible broadening of the scope, of when accidents should be investigated depending on their severity and type of vessel, should also be considered.
