Judgment in Case T-256/23 Mylan Ireland v Commission

In this case, the applicant Mylan Ireland Ltd (Dublin, Ireland), a pharmaceutical
company that develops and markets various medicines, including generic medicines,

asked the General Court to annul the contested decision, Commission Implementing
Decision C(2023)3067(final) of May 2, 2023. The decision amended the marketing
authorisation (MA) initially granted by Decision C(2014)601(final) for “Tecfidera –

Dimethyl fumarate,” a medicinal product for human use, and extended the market
exclusivity period for intervener Biogen Netherlands BV’s drug Tecfidera from
February 3, 2024 to February 2, 2025.
During that period, the marketing of any generic version of Tecfidera, including the
applicant’s Dimethyl Fumarate Mylan, was made impossible by the contested decision.

Four professional athletes who violated anti-doping rules are challenging in an
other cases.
Austrian court the fact that their names, the sport concerned, the duration of their
exclusion from sporting events and the reasons for this exclusion were or were going
to be published online, namely on the websites of the Austrian Independent AntiDoping Agency (NADA Austria) and the Austrian Anti-Doping Legal Commission
(ÖADR).
In Austria, such publication is required by law. Its purpose is, on the one hand, to deter
athletes from committing anti-doping rule violations and thus to prevent doping in
sport. On the other hand, it aims to prevent the circumvention of anti-doping rules by
informing all persons likely to sponsor or engage the athlete in question that he or she
is suspended.
The four athletes concerned believe that this publication violates the General Data
Protection Regulation (GDPR).
In this context, the Austrian court asked the Court of Justice to interpret the GDPR,
after the Court had dismissed a request for a preliminary ruling submitted by the
Austrian Independent Arbitration Committee as inadmissible (see C-115/22 and Press
Release No 80/24).

Judgments in Cases T-600/23 BNetzA v ACER and T-612/23 Germany v ACER

In 2015, the European Commission adopted a regulation concerning, in particular, the
management of day-ahead and intraday markets in the electricity sector. It established
common methodologies for calculating day-ahead and intraday cross-zonal capacity in
each of the capacity calculation regions. The capacity calculation region comprises
Belgium, the Czech Republic, Germany, France, Croatia, Luxembourg, Hungary, the
Netherlands, Austria, Poland, Romania, Slovenia and Slovakia (the ‘CORE region’).
The electricity transmission system operators in each capacity calculation region were
required to define proposals for methodologies for calculating capacity in their

respective regions and submit them to the relevant national regulatory authorities for
approval.
These national authorities were then required to attempt to reach an agreement and
take a decision on the proposals, failing which the European Union Agency for the
Cooperation of Energy Regulators (ACER) would decide.
On February 21, 2019, ACER took a decision. The competent German national
authority, the Bundesnetzagentur für Elektrizität, Gas, Telekommunikation, Post und
Eisenbahnen (BNetzA), appealed against this decision before the General Court.
In 2022, the latter overturned the decision. However, in 2023, ACER’s appeal
committee upheld the initial decision. The BNetzA (T-600/23) and Germany (T-612/23)
challenged this latest decision before the General Court.
