*Treasury to Publish 30-Day Notice for the Report to Collect Beneficial Ownership Information from Reporting Companies*
On September 29, 2023, the Department of the Treasury, on behalf of the Financial Crimes Enforcement Network (FinCEN), will publish in the Federal Register a 30-day notice [ https://www.federalregister.gov/public-inspection/2023-21293/agency-information-collection-activities-proposals-submissions-and-approvals-beneficial-ownership ] pursuant to the Paperwork Reduction Act of 1995 (PRA) for the beneficial ownership information report (BOIR).
The 30-day notice seeks comment on the mechanism that FinCEN intends to use to collect beneficial ownership information from reporting companies as set out in the final Beneficial Ownership Information Reporting Requirements Rule [ https://www.govinfo.gov/content/pkg/FR-2022-09-30/pdf/2022-21020.pdf ] [ https://www.govinfo.gov/content/pkg/FR-2022-09-30/pdf/2022-21020.pdf ].  
Previously, FinCEN issued a 60-day notice [ https://www.federalregister.gov/documents/2023/01/17/2023-00703/agency-information-collection-activities-proposed-collection-comment-request-beneficial-ownership ] for public comment on the BOIR.  FinCEN carefully considered the comments received and, as a result, expects to adopt a revised approach to the BOIR.  This revised approach includes a first implementation that would be used starting January 1, 2024, and a potential alternative implementation that may be adopted at a later date. 
The notice is being issued pursuant to the PRA and gives the public an opportunity to comment on: (1) the BOIR; and (2) FinCEN’s estimate of the burden involved in preparing and submitting that report.  The notice requests feedback on or before October 30, 2023.  FinCEN encourages the public to review this notice and provide comment.
