Rapporteur condemns exclusion of candidates from Azerbaijani parliamentary elections as ‘undemocratic’

Strasbourg, 14.01.2020 – Sunna Ævarsdottir (Iceland, SOC), rapporteur on ‘reported cases of political prisoners in Azerbaijan’, today condemned the exclusion of Ilgar Mammadov and other potential candidates from the Azerbaijani parliamentary elections on 9 February.

“At the beginning of December, the Committee of Ministers called on Azerbaijan to implement judgments of the European Court of Human Rights by ensuring that Ilgar Mammadov and other former political prisoners could stand as candidates in the next parliamentary elections”, recalled Ms Ævarsdottir.

“Azerbaijan’s failure to fulfil this binding obligation shows contempt for the authority of the Court and the Committee of Ministers and disdain for the rule of law. By excluding genuine opposition from the electoral process, the current regime reveals its increasingly undemocratic nature.

This new failure creates a legal and political crisis of unprecedented gravity. Azerbaijan has already failed to respond to the ‘nuclear option’ of infringement proceedings. The Committee of Ministers must now decide what further action to take,” she concluded.

Une rapporteure condamne l’exclusion de candidats aux élections législatives azerbaïdjanaises, qu’elle qualifie ‘d’antidémocratique’

Strasbourg, 14.01.2020 – Sunna Ævarsdottir (Islande, SOC), rapporteure sur les « cas signalés de prisonniers politiques en Azerbaïdjan », a condamné aujourd’hui l’exclusion d’Ilgar Mammadov et d’autres candidats potentiels aux élections législatives azerbaïdjanaises du 9 février.

« Début décembre, le Comité des Ministres a appelé l’Azerbaïdjan à exécuter les arrêts de la Cour européenne des droits de l’homme, en veillant à ce qu’Ilgar Mammadov et d’autres anciens prisonniers politiques puissent se porter candidats aux prochaines élections législatives », a rappelé Mme Ævarsdottir.

« Le manquement de l’Azerbaïdjan à cette obligation contraignante témoigne d’un mépris de l’autorité de la Cour et du Comité des Ministres et d’un mépris de l’Etat de droit. En excluant une véritable opposition du processus électoral, le régime actuel révèle son caractère de plus en plus antidémocratique.

Ce nouvel échec crée une crise juridique et politique d’une gravité sans précédent. L’Azerbaïdjan n’a pas répondu à l’ultime levier du recours en manquement. Le Comité des Ministres doit maintenant décider des mesures à prendre », a-t-elle conclu.
